There’s been a development in one ofNintendo’s latest lawsuits, with an alleged seller of moddedNintendo Switchconsoles denying any wrongdoing. Ryan Daly, who allegedly operates the online store Modded Hardware, is rejecting Nintendo’s claims and is representing himself without a lawyer.
As reported byTorrent Freak(spotted byVGC), Daly did have a lawyer but sought alternative legal advice after initially agreeing to stop selling modded Switch consoles. However, Daly is now denying that he is the owner and operator of Modded Hardware, while also denying other claims on the basis of fair use, statutes of limitations, and various other defences.
Alleged Owner Of Modded Hardware Store Is Fighting A Lawsuit With Nintendo
Nintendo launched its lawsuit against Daly back in July, alongside another lawsuit against a moderator of the subreddit r/SwitchPirates. Both were sued for their alleged role in the piracy of Nintendo Switch software, which reportedly included offering advice on how to circumvent restrictions put in place by Nintendo.
Now, Daly has made it clear that he intends to fight the lawsuit, denying that he is the owner and operator of Modded Hardware.
Modded Hardware was said to have sold items such as mod chips, which allowed users to play pirated games on their Switch, as well as pre-modded consoles. It is also claimed that Daly invited customers to send their consoles to him so he could send them back modded and containing pirated games. Nintendo seeks damages from Daly for this alleged behaviour. Daly denies all of these claims.
As noted by Torrent Freaks, the Modded Hardware store has now been taken offline. It remains to be seen how this case proceeds, and if Daly takes legal advice at all, or if he will continue to represent himself in court.
